Bridging the Gap: Establishing Guardrails for Human Oversight in AI Governance

Artificial intelligence (AI) is reshaping critical decision-making in hiring, lending, and other high-stakes areas. While AI governance frameworks emphasize the role of human oversight to prevent algorithmic bias, the reality is more complex. As highlighted in a recent European Commission study (The Impact of Human-AI Interaction on Discrimination, Jan 2025) on AI-driven discrimination, human oversight alone is not a fail-safe solution. If those entrusted with AI oversight lack diversity in perspective, background, and experience, they risk reinforcing the very biases AI is meant to mitigate.



The Challenge: Bias in Human Oversight


The European Commission’s study clearly states:

"We do acknowledge that human oversight is crucial in managing AI systems. However, our study showed that human overseers brought their own biases, predispositions, values, and past experiences."


This insight exposes a significant challenge: While human intervention is critical to ethical AI, it does not automatically lead to fairer outcomes. In some cases, human biases override fair AI recommendations, reinforcing discrimination rather than mitigating it.

A key question that arises when discussing human oversight is who the human overseers are. Notably, the study does not explicitly provide data on the diversity of the human decision-makers who participated. As we know from existing research, diverse oversight—incorporating different backgrounds, experiences, and perspectives—is crucial to reducing bias in decision-making. Without this element, human oversight risks reflecting the same systemic biases that AI governance is trying to address.


This is particularly relevant in hiring and finance, where AI is increasingly used to evaluate applicants. If oversight is shaped by individuals or structures that do not reflect the diversity of the populations impacted by these decisions, AI-assisted outcomes may continue to perpetuate inequalities rather than correct them.



The Need for Systemic Guardrails


A crucial takeaway from the study is the call for better societal mechanisms to support ethical decision-making:

"Development of better societal guardrails to guide individual decision-making. Those guardrails can both be necessary and effective. Indeed, in the same way that society can generate biases in individuals, it can also provide the tools to correct them."


To build these guardrails, we need to move beyond technical AI fixes and connect AI governance to the broader legal and policy frameworks already in place to promote fairness and human rights. The EU has long-established regulations protecting against discrimination and inequality, and the European Charter of Fundamental Rights enshrines fairness, dignity, and equal treatment as legal imperatives. Yet, according to the study, perhaps the AI policies are developed in isolation from these frameworks. As the study points out:

"This analysis shows that it's important to connect discussions about fairness in AI with a wider range of existing EU policies... the full spectrum of EU initiatives that aim to protect fundamental values."
